Norway – Planting and maintenance services of green areas – Operation of green areas - reserved contract

Heim municipality shall engage a company to operate the municipality ́s green areas, in the form of lawns, clearing up, and transport of garden waste and waste to the recycling station. The contracting authority intends to enter into a contract with Allvekst AS without a prior competition. The procurement is implemented pursuant to the Public Procurement Regulations § 8-8, which allows contracts to be reserved for entities whose main aim is to integrate persons with reduced functional abilities or disadvantaged persons in working life, provided that at least 30% of the employees belong to this group. Allvekst AS is an entity that has its primary purpose of offering adapted work for persons with reduced functional ability, and the company fulfils the requirement that at least 30% of the employees are persons who fall under the regulation ́s definition. The contracting authority has assessed the market and found that Allvekst AS is the only entity in the area that can deliver the relevant service within the framework of a reserved contract pursuant to § 8-8, and that simultaneously fulfils the professional and social purposes that form the basis of the procurement. Based on this, the contracting authority considers it legally possible to enter into a contract directly with Allvekst AS, in accordance with the procurement regulations § 8-8. This intention notice will be published in order to ensure transparency and give the market the opportunity to assess the legality of the planned contract signing.
