Norway – Construction work – Intention to procure sheltered accommodations

Alver municipality would like to use this intention notice to sign a contract with Alverporten Bolig AS. The contract is for the procurement of sheltered accommodations, as well as a personnel base and day centre in Knarvik. In case PS 48/26, Alver Municipal Council has given the municipal director the authority to announce intention notice. The municipal council decision states that the municipal director shall return to the municipal council before any agreement is signed. According to the contracting authority's assessment, the procurement shall be based on the work area of the procurement law and the regulations, cf. the Public Procurement Regulations § 2-4 letter a. Føresegna debt purchase or hire of existing buildings, but it is consequently from case law that the exception also includes the purchase or hire of buildings that are not listed. The reason for this is that the contract is a real purchase contract and not in the procurement of a construction contract. Alver municipality has seen as a guideline that relevant armies must fulfil Husbanken's reglar for welfare buildings, but there is no work required for the construction work. The municipality ́s risk is limited to paying the agreed purchase price when the terms for taking over are met. The project consists of 63 leilegheiter as well as a personnel base and day centre.
